אנו – עיתונאיות, עיתונאים ואנשי תקשורת החרדים לחופש הפעולה המקצועי שלנו, קוראים ליועץ המשפטי לממשלה שלא להעמיד לדין את עיתונאי "הארץ" אורי בלאו על החזקת מסמכים מסווגים. חלקנו מסוייג מההתנהלות של בלאו ועיתון "הארץ" לאורך הפרשה. אך כולנו מודאגים מההשלכות של החלטת היועץ המשפטי לממשלה על עבודתם השוטפת של כלל אנשי התקשורת בישראל. הפרקליטות הודיעה (23.3.11) על הכוונה להעמיד לדין את בלאו בגין "החזקת ידיעות סודיות על-ידי מי שאינו מוסמך לכך (בלי כוונה לפגוע בבטחון המדינה)", בכפוף לשימוע שיערך בפני היועץ המשפטי לממשלה. העמדת עיתונאי לדין בגין החזקת מסמכים סודיים מהווה פגיעה מהותית בעצמאותם של כלי התקשורת. המשמעות המיידית של ההחלטה היא הצרת צעדינו ויכולתינו לחשוף עוולות ושחיתויות שאין להן מקום בחברה הישראלית. זהו תקדים שיפגע אנושות בעיתונות החוקרת, שהיא נשמת אפה של העיתונות החופשית. אי אפשר לחשוף שחיתויות, בכל תחום שהוא, מבלי להחזיק במסמכים – גם כאלו הנחשבים מסווגים - שיספקו את התשתית העובדתית. חשוב להזכיר כאן, כי הכתבה שהתבססה על המסמכים האמורים הוגשה טרם הפרסום על ידי בלאו ועיתון "הארץ" לצנזורה הצבאית ואושרה לפרסום כנדרש על פי דין. אנחנו קוראות וקוראים ליועץ המשפטי לממשלה לא להעמיד את בלאו לדין ולהסתפק בכך שהחזיר את כל המסמכים הסודיים שהיו בידיו, על פי הסיכום שהושג בין "הארץ" לבין מערכת הביטחון. הגשת כתב אישום נגד עיתונאי בנסיבות אלו – לראשונה בישראל – היא פסיעה לא זהירה במדרון תלול, שבתחתיתו יבצר מכלי ואנשי התקשורת למלא את תפקידם כמגני הדמוקרטיה.

Journalists demand Haaretz reporter Uri Blau not be prosecuted
Around 200 Israeli journalists have already signed the Hebrew version of the following petition – Calling Israel's Attorney General not to prosecute Ha'aretz investigative reporter Uri Blau for holding classified documents. Dear Mr. Weinstein,
We – journalists and commentators from around the globe, fearing for the professional freedom of our Israeli colleagues – call upon you to refrain from prosecuting Haaretz journalist Uri Blau for unlicensed possession of classified materials. Some of us have our reservations regarding the conduct of Mr. Blau and Haaretz in the affair. But all of us are concerned with the ramifications a decision to prosecute Mr Blau would have for the vitally important work of the Israeli media.
On March 23, the Israeli prosecution service announced it intends to charge Mr Blau with "retaining secret information by an unauthorized person (without intention to harm the security of the state)", pending a hearing before the Attorney General. Trying a journalist for possession of classified secret documents would gravely infringe upon the freedom of the Israeli press. Such a move would immediately constrain our Israeli colleagues' freedom of action, and their ability to expose corruption and other wrongs afflicting their society.
Putting Mr. Blau on trial would set a precedent that would damage investigative journalism, the very essence of free media, beyond repair. It is impossible to expose corruption without using documents – including classified documents – to build up the factual infrastructure for the report. In this specific case, we should stress that the report based on the documents in questions was submitted to and confirmed for publication by the Israeli military censorship, We call upon you not to prosecute Mr. Blau, and to make do with the fact that Mr Blau had already returned all the classified documents in his possession to the state, as per an earlier agreement between Haaretz and the Israeli security services.
Prosecuting a reporter in such circumstances, for the first time in Israeli history, is a careless step down a slippery slope, at the bottom of which lies an end to the ability of Israeli journalists and media to fulfill their task as the guardians of democracy.

אבש לצרף את חתימתי לעצומה נגד העמדתו לדין של אורי בלאו. משום מה לא הצלחתי לשלוח הודעה בדוא"ל. תודה רבה, חיים ברעם, כל העיר
להכניס אותו לכלא או להעיף אותו מהארץ לקיבינימאט!!!
העמדה לדין של אורי בלאו היא איום גלוי נגד כל אזרח שמחזיק מידע ולא מפרסם אותו ללא רשות חוקית. יש אלפי אזרחים – ממי ש"יושבים" על סליק מלפני קום המדינה ועד מי שהתגלגלו אליו מסמכים במקום העבודה, והוא שומר עליהם מפני השמדה על-ידי מושחתים, למשל.
האם חשבו, לפחות, לעשות יום "החזרת ציוד" למסמכים שבידי האזרחים?
ובכל מקרה – עיתונאי שאוסף חומר אסור שיהיה חשוף לידו הארוכה של שלטון, יד שמופעלת שרירותית ואולי גם כדי לחפות על פשלות ושחיתות.
ככל שהחברה הישראלית הופכת להיות בהמית יותר, ככה ביטויי ה"פטריוטיות" שלה הופכים להיות אלימים יותר – למשל העמדה לדין של עיתונאי בעניין מופרך כזה. לפיכך את ביטויי הבהמיות לא צריך לחפש רק אצל אלה שמתכוונים להעמיד את בלאו לדין, אלא אצל כל אחד מאיתנו שחי בשלום עם מציאות בזויה שבה שליש מהציבור הישראלי חי בעוני, ושבה ישראל מרושתת בארגוני פשע רצחניים- ושבה יתכן שאדם גס/בהמי יסכים להשתכר הון עתק בה בעת ששכנו רעב ללחם – והדובדבן: ששבעה אנשים מתוך כל עשרה חווים אפליה, ולא רק זה – אלא שחלקם אף משתתף בה כשהם מפלים מופלים אחרים
